Terms of Service

By downloading, installing, accessing, or using the Dappy mobile application ("App") or visiting dappy.app ("Website"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, incorporated herein by reference.

If you do not agree to these Terms, do not use Dappy. These Terms constitute a legally binding agreement between you ("User", "you") and Dappy ("Company", "we", "us").

Dappy is a mobile application that monitors cryptocurrency and forex market prices via the Binance public API and delivers push notifications to your device when prices reach user-configured thresholds.

Core Service Features:

• Real-time price monitoring of 300+ trading pairs from the Binance public market data API
• Configurable upper (UP) and lower (DN) price alert bounds per pair
• Step-based recurring notifications — when a bound is triggered, it automatically advances by your configured step amount
• Push notification delivery to iOS (APNs) and Android (FCM) devices
• Alert history log (extent varies by subscription plan)
• Four subscription tiers: Free, Silver, Gold, Diamond

Dappy uses the Binance public API in read-only mode for price data. Dappy is not affiliated with, endorsed by, or officially connected to Binance. Market data is provided for informational purposes and may be subject to delays or inaccuracies.

Eligibility: You must be at least 13 years old (or 16 in the EEA) to use Dappy. By registering, you represent that you meet this requirement.

Your Responsibilities:

• Maintain the confidentiality of your account credentials
• Be responsible for all activity that occurs under your account
• Provide accurate and current information during registration
• Notify us immediately of any unauthorised use at support@dappy.app

One Account Per User: Each user may maintain one active account. Creating multiple accounts to circumvent subscription limitations is prohibited and may result in termination of all associated accounts without refund.

Account Deletion: You may delete your account at any time via Settings → Delete Account. Your data will be permanently removed within 30 days of deletion.

Dappy offers four subscription tiers with the following features:

Billing Terms:

• All paid subscriptions are processed through Apple App Store or Google Play. Dappy does not handle payment card information directly.
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• Yearly subscriptions offer approximately 17% savings over the monthly equivalent.
• Prices are displayed in your local currency and may vary by region per Apple/Google pricing guidelines.

Monthly quotas reset on the first day of each calendar month. Unused notifications do not roll over. On plan downgrade, changes take effect at the next billing cycle. Pairs exceeding the new tier's limit will be deactivated (not deleted) until you upgrade again.

You agree to use Dappy only for lawful purposes. You agree not to:

• Use automated means, bots, or scripts to access or interact with the service
• Attempt to gain unauthorised access to any part of the service or other user accounts
• Reverse engineer, decompile, disassemble, or extract source code from the app
• Create multiple accounts to circumvent notification quotas or plan limitations
• Interfere with or disrupt the integrity or performance of the service
• Upload or transmit malicious code, viruses, or any harmful material
• Use the service in violation of any applicable local, national, or international law
• Misrepresent your identity or affiliation with any person or organisation

Violation of these terms may result in immediate suspension or termination of your account without refund.

Our Property: The Dappy application, website, logo, brand name, interface design, code, and all associated intellectual property are owned by or licensed to Dappy and are protected by copyright, trademark, and other applicable IP laws.

Limited Licence: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Dappy app on your personal device for personal, non-commercial purposes.

Restrictions: You may not copy, modify, distribute, or create derivative works based on the app, or remove any proprietary notices. Use of the Dappy name, logo, or branding requires our prior written permission.

Your Data: You retain ownership of alert configurations you create. By using the service, you grant us a limited licence to process this data solely to provide the notification service to you.

Market Data Accuracy: Price data is sourced from the Binance public API. We make no warranties regarding the accuracy, completeness, timeliness, or reliability of price information. Data may be delayed or unavailable due to technical issues outside our control.

Service Availability: We do not guarantee uninterrupted or error-free access. Notifications may be delayed or undelivered due to device settings, network conditions, third-party service disruptions, or other technical failures.

Disclaimer of Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• DAPPY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
• DAPPY SHALL NOT BE LIABLE FOR FINANCIAL LOSSES ARISING FROM TRADING OR INVESTMENT DECISIONS MADE IN CONNECTION WITH THE SERVICE.
• DAPPY SHALL NOT BE LIABLE FOR MISSED OR DELAYED NOTIFICATIONS DUE TO DEVICE SETTINGS, NETWORK ISSUES, THIRD-PARTY SERVICE FAILURES, OR CAUSES OUTSIDE OUR DIRECT CONTROL.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO DAPPY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) EUR 10 (TEN EUROS).

Some jurisdictions do not allow certain liability exclusions, so the above may not fully apply to you.

We aim to deliver push notifications within under 1 second of a price threshold being crossed. However, delivery is subject to factors outside our control.

Factors that may affect delivery:

• Notification permissions disabled on your device
• Device battery saver or low-power mode restricting background activity
• Network connectivity issues on the device
• Disruptions to Apple APNs or Google FCM infrastructure
• Temporary interruptions to the Binance price data API
• App being force-quit on iOS (which may limit background push delivery)

We do not offer compensation or subscription credits for missed or delayed notifications regardless of cause, consistent with the Disclaimer in Section 7.

The app or website may link to third-party websites or services not owned or controlled by Dappy. These are provided for convenience only.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. We encourage you to review the terms and privacy policies of Apple, Google, and Binance, whose services are integral to Dappy's operation.

By You: You may delete your account at any time from within the app. Active paid subscriptions must be cancelled separately through App Store or Google Play.

By Us: We reserve the right to suspend or terminate your account, with or without notice, if you breach these Terms, if required by law, or if we reasonably believe continued access poses a security risk.

Effect of Termination: Your access immediately ceases. Your data will be deleted per our Privacy Policy. Sections 6, 7, 8, and 12 survive termination. If we terminate without cause, we will provide a pro-rated refund for any prepaid subscription period.

These Terms shall be governed by the laws of the jurisdiction in which Dappy is registered, without regard to conflict of law provisions.

EU Users: Nothing in these Terms affects your rights as a consumer under applicable EU law, including the EU Consumer Rights Directive and GDPR.

Dispute Resolution: Please contact us first at support@dappy.app to resolve any dispute informally. If unresolved within 60 days, either party may pursue resolution through the competent courts. EU consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may modify these Terms at any time. We will notify you of material changes by posting revised Terms with an updated date and sending an in-app notification or email for significant changes. We will give at least 14 days' notice before material changes take effect, except where required by law.

Your continued use of Dappy after changes take effect constitutes acceptance. If you do not agree to revised Terms, you must stop using the service.
